A Louisville man will not be re-tried for the death of a gas station clerk nearly three decades ago.

Percy Phillips' first trial ended last month with a hung jury.

He was accused of the 1993 shooting death of Brenda Whitfield during a gas station robbery.

His arrest did not come until 2009 after another man was exonerated for the crime.

The Commonwealth Attorney's office cited several problems with re-trying the case, including issues with evidence and the fact that the lead detective was convicted of perjury.
